What happens when a third-party files an opposition to your trademark registration? Fujitsu, applicant for the iPad trademark, will now likely face a trademark opposition from Apple in front of the United States Patent and Trademark Office (USPTO).
Earlier in the month, MacRumors reported that Apple's shell company IP Application Development, LLC sought registration of the iPad mark, despite the fact that Fujitsu filed an application for trademark registration with the USPTO in March 2002 for the iPad mark for use in association with handheld computing devices. Apple has sought to extend the time to file an opposition to Fujitsu's iPad trademark registration application, and in light of the recent release of the Apple iPad it appears that the two companies will now face off in a trademark opposition proceeding in front of the USPTO. The New York Times reports that Fujitsu intends to defend the mark and its registration.
