The Auction for New gTLD Applications

If you go through the list, there is a large number of applications which are going to end up in the gTLD auction process where these TLD applicants are going to have to bid against each other potentially if they can't negotiate between themselves a resolution about who gets to offer the gTLD and under which application, under which business model.

Welcome to Domain Name Law Radio. Domain names are valuable assets.  Domain disputes, domain theft, cybersquatting, and domain monetization are important issues.  Our domain lawyers have answers to your domain name questions.

One thing that you're going to notice when you take a look at the new gTLD applications that have been filed is there is a lot of competition for a lot of domain names for which a lot of folks have put in an application to become a registry. For instance, there is any number of applications for .yoga. There is any number of applications for .wow. There is any number of applications for .wine. Any number of applications for .wedding, .website, .web.

If you go through the list, there is a large number of applications which are going to end up in the gTLD auction process where these TLD applicants are going to have to bid against each other potentially if they can't negotiate between themselves a resolution about who gets to offer the gTLD and under which application, under which business model. If you are a new gTLD applicant and you find yourself competing against someone else who's also put in an application for that new gTLD, what you need to do is you need to formulate a strategy on whether or not you want to work together or try and leverage the other gTLD to drop their application. If you can, you want to avoid getting into a bidding war against a new gTLD applicant for the same gTLD top level domain. That's the goal, right?

Our lawyers at Traverse Legal specialize in Internet law issues and domain name issues. We can help you negotiate your gTLD bidding process and strategy for negotiation so that you can try and maximize the investment that you've already made in order to get to a resolution, a potential contract between the parties as to how it is you believe you want to run forward with the competing company.
